TERMS OF SERVICE & USER AGREEMENT Last Updated: February 25, 2026
THIS TERMS OF SERVICE AND USER AGREEMENT ("AGREEMENT") IS A BINDING LEGAL CONTRACT BETWEEN YOU ("USER," "YOU," OR "SUBSCRIBER") AND FLOW COMPANION, A WYOMING LIMITED LIABILITY COMPANY D/B/A FLOW COMPANION ("FLOW COMPANION," "WE," "US," OR "OUR").
BY ACCESSING, SUBSCRIBING TO, OR USING THE FLOW COMPANION DISCORD SERVER, WEBSITE, OR ANY ASSOCIATED CONTENT (COLLECTIVELY, THE "SERVICES"), YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, YOU MUST IMMEDIATELY CEASE USE OF THE SERVICES.
NOTICE OF BINDING ARBITRATION AND CLASS ACTION WAIVER: THIS AGREEMENT CONTAINS A MANDATORY BINDING ARBITRATION PROVISION (SECTION 12) AND A CLASS ACTION WAIVER. THESE PROVISIONS AFFECT YOUR LEGAL RIGHTS TO SUE IN COURT AND RESOLVE DISPUTES. PLEASE READ THEM CAREFULLY.
1. EDUCATIONAL NATURE OF SERVICES NO FINANCIAL ADVICE 1.1. Educational Purpose Only The Services provided by Flow Companion, including but not limited to live streams, text chats, signal alerts, trade examples, and market commentary, are provided strictly for informational and educational purposes only.
1.2. No Investment Advice Flow Companion is NOT an investment adviser, broker dealer, financial planner, or registered financial professional. We do not provide personalized financial, investment, legal, or tax advice. No content provided constitutes a recommendation that any particular security, portfolio of securities, transaction, or investment strategy is suitable for any specific person.
1.3. No Fiduciary Relationship You acknowledge and agree that no fiduciary relationship is formed between you and Flow Companion. You maintain absolute discretion and control over your own accounts and trading decisions. Flow Companion does not have access to or control over your funds.
2. RISK DISCLOSURE AND ASSUMPTION OF RISK
2.1. High Risk Warning Trading in securities, equities, options, futures, and other financial instruments involves a significant risk of loss. You understand that you could lose all or substantially all of your initial investment. Options trading, in particular, carries inherent risks and is not suitable for all investors.
2.2. No Guarantees PAST PERFORMANCE IS NOT INDICATIVE OF FUTURE RESULTS. Flow Companion makes no representation, warranty, or guarantee that any trade example, signal, or strategy discussed will result in a pro t or will not result in a loss.
2.3. User Responsibility You agree that you are solely responsible for your own trading decisions. You should not trade with money you cannot afford to lose. You agree to conduct your own due diligence and consult with a certified financial professional before making any investment decisions.
3. ELIGIBILITY AND USER REPRESENTATIONS By using the Services, you represent and warrant that: • You have the legal capacity to enter into this Agreement • You are at least eighteen (18) years of age or the legal age of majority in your jurisdiction • Your use of the Services does not violate any applicable law or regulation in your jurisdiction • You are accessing the Services for personal, non commercial use only.
4. SUBSCRIPTION, PAYMENTS, AND CANCELLATION
4.1. Payment Processing Subscriptions and payments are processed through Whop (or such other third party processor as we may designate). By subscribing, you agree to comply with Whop's Terms of Service.
4.2. Automatic Renewal Your subscription will automatically renew at the end of each billing cycle (monthly) unless you cancel prior to the renewal date. You authorize us (via Whop) to charge your payment method for the renewal term.
4.3. STRICT NO REFUND POLICY ALL SALES ARE FINAL. FLOW COMPANION MAINTAINS A STRICT NO REFUND POLICY. WE DO NOT OFFER REFUNDS FOR PARTIAL MONTHS, NON USAGE, DISSATISFACTION WITH THE SERVICE, OR TRADING LOSSES. IF YOU CANCEL, YOU WILL RETAIN ACCESS UNTIL THE END OF YOUR CURRENT BILLING PERIOD.
4.4. Cancellation You may cancel your subscription at any time through the Whop dashboard. Cancellation stops future billing but does not result in a refund of previously paid fees.
5. INTELLECTUAL PROPERTY AND RESTRICTIONS
5.1. Proprietary Rights All content, including but not limited to trade signals, alerts, educational videos, and written analysis, is the exclusive intellectual property of Flow Companion.
5.2. Limited License We grant you a limited, revocable, non exclusive, non transferable license to access the Services for your personal, private use.
5.3. Prohibited Conduct (Leaks and Reselling) You are strictly prohibited from: • Reselling access to the Services • Copying, redistributing, publishing, or "leaking" any content, signals, or alerts to any third party or external platform • Using any automated system, scraper, or bot to access the Services
VIOLATION OF THIS SECTION WILL RESULT IN IMMEDIATE TERMINATION OF YOUR ACCOUNT WITHOUT REFUND AND MAY SUBJECT YOU TO CIVIL LITIGATION FOR DAMAGES.
6. USER CONDUCT AND MODERATION You agree to treat all members and staff with respect. Harassment, hate speech, spamming, promotion of other services, or illegal activities are strictly prohibited. Flow Companion reserves the right to suspend or ban any user, at its sole discretion, for violation of these rules, without refund.
7. DISCLAIMER OF WARRANTIES THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, FLOW COMPANION DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR FREE, OR FREE OF VIRUSES.
8. LIMITATION OF LIABILITY IN NO EVENT SHALL FLOW COMPANION, ITS MANAGERS, MEMBERS, EMPLOYEES, AFFILIATES, OR AGENTS BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER RESULTING FROM: • Your access to or use of the Services • Any trading losses, lost profits, or financial damages • Any unauthorized access to our servers • Any interruption or cessation of transmission to or from the Discord platform
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO US IN THE ONE (1) MONTH PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
9. THIRD PARTY PLATFORMS You acknowledge that the Services are hosted on Discord. We are not responsible for the availability, functionality, or policies of Discord. Discord's Terms of Service apply to your use of their platform.
10. INDEMNIFICATION You agree to defend, indemnify, and hold harmless Flow Companion and its officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney's fees) arising from: • Your use of the Services • Your violation of any term of this Agreement • Your violation of any third party right or applicable law
11. GOVERNING LAW This Agreement shall be governed by and construed in accordance with the internal laws of the State of Wyoming, without regard to its conflict of law principles.
12. DISPUTE RESOLUTION BINDING ARBITRATION CLASS ACTION WAIVER 12.1. Binding Arbitration ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THIS AGREEMENT OR THE BREACH, TERMINATION, ENFORCEMENT, INTERPRETATION, OR VALIDITY THEREOF, SHALL BE DETERMINED BY BINDING ARBITRATION IN CHEYENNE, WYOMING, BEFORE ONE ARBITRATOR. THE ARBITRATION SHALL BE ADMINISTERED BY JAMS OR THE AAA PURSUANT TO THEIR RESPECTIVE RULES. JUDGMENT ON THE AWARD MAY BE ENTERED IN ANY COURT HAVING JURISDICTION. 12.2. Class Action Waiver YOU AND FLOW COMPANION AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
13. MODIFICATION OF TERMS Flow Companion reserves the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website or Discord server. Your continued use of the Services after such notice constitutes acceptance of the modified Terms.
14. SEVERABILITY If any provision of this Agreement is found to be invalid or unenforceable, that provision shall be enforced to the maximum extent possible, and the remaining provisions shall remain in full force and effect.
15. ENTIRE AGREEMENT This Agreement constitutes the entire agreement between you and Flow Companion regarding the Services and supersedes all prior agreements and understandings, whether written or oral.
16. NO WAIVER No waiver of any term of this Agreement shall be deemed a further or continuing waiver of such term or any other term, and Flow Companion's failure to assert any right or provision under this Agreement shall not constitute a waiver of such right or provision.
17. ASSIGNMENT You may not assign or transfer this Agreement without our prior written consent. Flow Companion may assign this Agreement without restriction.
18. SURVIVAL Sections 2, 5, 7, 8, 10, 11, 12, and 14 through 18 shall survive any termination or expiration of this Agreement.
19. FORCE MAJEURE Flow Companion shall not be liable for any failure or delay in performance due to circumstances beyond its reasonable control, including acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.
20. NOTICES All notices to Flow Companion must be sent to info@flowcompaniontrading.com. All notices to you may be sent to the email address associated with your Whop account.
